Aryan Khan has been finally granted bail in a drugs-on-cruise case after three weeks in jail, by the Bombay High Court. The 23-year-old son of Shah Rukh Khan was detained by the Narcotics Bureau Of Control for the illegal consumption and possession of drugs. The star kid has been in the NCB custody since October 2, remanded to judicial custody from October 7, and finally sent to Arthur Road jail from October 8 onwards.
His lawyers had repeatedly pointed out that no drugs were found on him while NCB argued that he was involved in dealing in illicit drug activities for narcotic substances on regular basis. Therefore, it cannot be said that Khan is not likely to commit a similar offense while on bail.
ASG Anil Singh stated in court, “My contention is he was found in possession. He was connected with drug peddlers. It was a commercial quantity. Hence we invoked 28 and 29. It was only 4 hours and they were aware of the grounds so it cannot be an illegal arrest. Conspiracy is difficult to prove. Only the conspirator knows how they conspired. I will leave to the conscience of the court.”
While Senior Advocate Mukul Rohatgi argued on Aryan Khan’s behalf and stated, “I knew only Arbaaz, I did not know anyone else. It is true it is difficult to prove that there is common meeting of mind. But facts cannot be ignored. There has to be meeting of minds. There may be conscious possession of 6 gms, but how do you prove the other recovered substance?”
Aryan Khan’s friend Arbaaz Khan and Munmun Dhamecha has also been granted bail today.
